Terms & Conditions | Foundations of Therapeutic Music

1. Who we are

The course content is developed, owned, copyrighted and presented by Mendel Kaelen (The “Instructor”). The course is hosted and managed by Wavepaths LTD (“we”, “us”, the “host”), Company nr 10485374, 16 Great Queen Street, Covent Garden, WC2B 5AH, London, United Kingdom. Contact: [email protected].

2. What you’re buying

The course can be purchased as two different product types:

  • The EXPERT version: Live and Interactive Course (fixed dates and limited cohorts, “Expert version” or “Tier1”): live lectures + Q&A • interactive working groups • Interactive playlist design workshop • new music recommendations • On-demand video recordings • Self-guided practice modules • Guided therapeutic listening experiences • Course Handout / E-book • 3 months of access to Wavepaths.
  • The ESSENTIALS version: On-Demand Course (digital content, “Essentials version” or “Tier 2”): Streaming lessons and materials available online for 12 months . PrRecorded video • Self-guided practice modules • Course Handout / E-book • 2 months of access to Wavepaths.

3. Eligibility & conduct

Participants must be 18 years of age or older. You agree to conduct yourself respectfully and lawfully at all times. Harassment, discrimination, abuse, illegal activity, impersonation, or disclosure of others’ personal information is strictly prohibited. You must not share or transfer your course access or login credentials, nor attempt to interfere with, disrupt, or circumvent any security or access controls. Violation of this clause may result in immediate suspension or termination of access without refund, and may give rise to legal action where applicable.

4. Community conduct & confidentiality

  • Live sessions, small-group labs and triads involve peer interaction. Confidentiality is required: do not share personal details or case material outside the group.
  • Be respectful of differing modalities and cultures; the course encourages multidisciplinary integration.
  • We may moderate or remove participants who breach these rules (without refund, except where required by law).

5. Right to Refuse or Terminate Participation

The Company reserves the right to refuse or terminate a participant’s enrolment at its sole discretion. If participation is refused prior to the course start date (12 January), the participant will receive a full refund of any fees paid, minus any third-party transaction fees. However, if participation is terminated after the course has commenced, due to a violation of these Terms and Conditions or any related policies, no refund will be issued.

6. Tech requirements & environment

Stable internet, a Zoom-compatible device, and headphones are required (especially for experiential practices and listening sessions). Some activities will involve eyes-closed focused listening and require a quiet, disturbance-free environment.

7. Accessibility & accommodations

We’ll make reasonable accommodations (e.g., captions/transcripts for replays, alternative assignments) on request at [email protected]. Many materials are audio-dependent; if you have accessibility needs, please let us know and we’ll suggest adaptations where feasible.

8. Access & schedule

  • The EXPERT version of the course (Tier 1) runs strictly on the published schedule.
  • For the ESSENTIALS version of the course (Tier 2), access begins at the time when we grant login and access to course materials (see §8 for cooling-off rules).

     

9. Cancellation & cooling-off — Cohort Courses

UK/EU consumers have 14 days from purchase to cancel (distance-selling rules). If your purchase is within 14 days of the published start, we will present a clear checkbox asking you to request that we commence delivery on the scheduled start date. If you tick it, we may charge a pro-rata amount for services supplied if you cancel during the 14-day period; once the course is fully performed, the right ends. To cancel, email [email protected]. Note: We do not rely on a “leisure activity” exemption; the standard 14-day rule applies.

10. Deferrals & mid-course withdrawals

 

  • One-time deferral (goodwill): If you miss a live start or plans change after the cooling-off window, you may request one free transfer to the next cohort.
  • The Company does not guarantee any specific start date or time for future cohorts, and cannot be held liable for any delay, change, or non-occurrence of a subsequent cohort. Participants who have been granted a deferral hold the right to join a future cohort only if and when such a cohort is offered, at the Company’s sole discretion.
  • Mid-course refunds: Once a cohort has started, no refunds are offered unless required by law (e.g., course not as described or not provided with reasonable care and skill). Eligible refunds are paid within 14 days by the company to the original payment method, excluding time needed of third parties to complete this refund (E.g. Stripe may take 10 days to process a refund, and banks an additional number of days) .

     

11. Fair use & intellectual property

Unless otherwise indicated, all course materials (including but not limited to videos, slides, workbooks, frameworks, audio recordings, written texts, and digital content ), are the sole intellectual property of Mendel Kaelen, the developer and instructor of this course. The Company acts solely as the hosting and distribution platform of this course. Upon enrolment, you are granted a personal, non-exclusive, non-transferable, revocable licence to access and use these materials solely for your own educational and therapeutic practice. This licence does not convey any ownership or rights to reproduce, distribute, or exploit the materials commercially. You expressly agree that you shall not, without prior written consent from Mendel Kaelen or the Company:

  • Record (audio, video, screen capture), transcribe, scrape, or redistribute any portion of live sessions, group work, or recorded materials.
  • Copy, reproduce, modify, share, or publicly display any course materials outside your personal learning use.
  • Use any course materials, playlists, frameworks, or tools to train, fine-tune, or evaluate artificial intelligence systems.
  • Repackage, white-label, sublicense, or sell any portion of the content, music, frameworks, or tools.
  • Any unauthorised use constitutes a material breach of these Terms and may result in immediate termination of access and potential legal action for copyright infringement.

Participants may freely use, adapt, and build upon the teachings for their own therapeutic, educational, or professional practice, but may not:

  • Present the course’s proprietary models, materials, or frameworks as their own original intellectual property;
  • Reproduce or teach substantial parts of the course content as an independent course, training, or certification;
  • Use the instructor’s name, brand, or trademarks without prior written consent.

Nothing in these Terms transfers ownership of the course materials to participants, nor does it limit their rights to create and own new, original works inspired by the course.

12. No professional advice — scope of practice

  • The training is educational and does not confer any licence or certification to practice therapy. You are responsible for staying within your professional scope and local regulations.
  • Content referencing psychedelic-adjacent contexts (e.g., KAP/PAT) is educational only. Clinical use requires appropriate licensure, supervision, and protocols.

     

13. Liability Waiver and Disclaimer

By enrolling in this course, you acknowledge and agree that all information, methods, practices, and materials provided are for educational purposes only and do not constitute medical, psychological, or therapeutic advice, diagnosis, or treatment.

The instructor, Mendel Kaelen, and the hosting company expressly disclaim all liability for any direct, indirect, incidental, or consequential damages, injuries, or adverse outcomes that may result from the use, misuse, or application of the concepts, techniques, or materials taught in this course — whether applied personally, professionally, or with clients or patients.

You agree to take full personal and professional responsibility for how you integrate and apply the course content, and to exercise sound judgment, ethical practice, and adherence to all applicable professional and legal standards in your field.

Participation in any experiential exercises, self-exploration, or therapeutic practices offered as part of the course is voluntary and undertaken at your own risk.

The instructor and hosting company make no guarantees regarding the outcomes, results, or suitability of any methods for specific individuals, clients, or clinical situations.

By proceeding with this course, you waive and release the instructor and host from any and all claims, liabilities, demands, or causes of action arising directly or indirectly from your participation or application of the course teachings.

14. How to cancel or complain (with SLA)

To cancel where permitted, email [email protected]. We aim to acknowledge within 2 business days and resolve most issues within 14 days. You may pursue alternative dispute resolution or court remedies where available.

15. Taxes & pricing

Prices are shown inclusive/exclusive of applicable taxes as indicated. We collect VAT/GST based on your billing country and applicable rules (e.g., UK VAT, EU OSS for digital services, AU/NZ GST where applicable).

16. Regional consumer rights (global customers)

Nothing in these Terms reduces mandatory consumer rights under the laws of your country of residence. Examples include UK/EU 14-day rules for distance contracts and consent rules for digital content; Australian Consumer Law guarantees.

17. Governing law & jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England shall have jurisdiction.
Consumer carve-out: If you are a consumer resident outside the UK, you may benefit from mandatory local consumer protections which prevail where required by law. EU consumers may also bring proceedings in their local courts.

18. Confidentiality, Recordings, and Use of Course Content

By enrolling in this course, you acknowledge and agree to the following:

Recording of Sessions: 

  • Certain live sessions, including group discussions, Q&A sessions, or lectures, may be recorded for the purposes of learning review, quality assurance, and participant access. These recordings may include audio, video, and chat transcripts.
  • Such recordings will be made available only to members of the same course cohort and will not be shared publicly without explicit written consent from all identifiable participants featured in the material.
  • Participation in these recorded sessions constitutes informed consent to being recorded under these conditions. Participants who do not wish to appear in recordings are responsible for disabling their camera, microphone, or identifiable name within the session platform.

Confidentiality and Privacy:

  • Participants agree to treat all information shared by others within the course — including personal disclosures, case examples, and discussions — as strictly confidential. You may not record, reproduce, or disclose any portion of live or recorded sessions, group discussions, or chat messages outside the cohort.
  • Breach of confidentiality or unauthorised distribution of recordings or materials constitutes a material violation of these Terms and may result in immediate removal from the course and potential legal action.

19. Third-party services & benefits

Access to any third-party tools or benefits (e.g., Wavepaths) is provided “as is” by the vendor, subject to their terms, and for a time-limited period as stated at checkout.
